Representing Lenders, Developers, and Special Servicer Clients in Complex Commercial Real Estate Litigation
Founding attorney Michael Woodbury has decades of experience representing lenders and special servicers in securitized and non securitized commercial foreclosure and lender liability litigation throughout Florida, as well as the host of litigation issues that owning foreclosed and other REO properties can present. We search for pragmatic solutions for complicated legal issues, but we bring to the table full litigation capabilities where needed. As a boutique firm, Woodbury Law prides itself on building and maintaining long-term relationships with our most important asset – our clients.
Commercial Real Estate Litigation Matters We Handle
Our practice encompasses representing clients in all types of commercial real estate matters. This includes (but is not limited to) providing representation for litigation and alternative dispute resolution (ADR) proceedings involving:
- CMBS Workouts and Foreclosures – Our lender-based enforcement practice has represented special servicers and CMBS Trust lenders for decades. Indeed, Mr. Woodbury was one of a very select group of attorneys authorized to represent the Lehman Brothers Holdings Inc. bankruptcy estate on real estate matters in the State of Florida, and has personally litigated and resolved hundreds of millions of dollars in distressed loans for his clients.
- Commercial Lessor-Lessee Disputes – We represent lessors and lessees in disputes involving commercial real estate leases and have achieved favorable results for our clients in disputes involving avoidance, assignment, termination, renewal, rent and CAM calculations, and a broad range of other matters.
- Litigation Between and Among Commercial Real Estate Buyers, Sellers, and Brokers – The Firm has significant experience helping clients resolve disputes arising out of commercial real estate transactions, litigating where necessary but always with a focus on what is best for the client in a particular circumstance.
